Whether a lot holding four mobile homes is a sales location or a mobile home park has led to dispute in valuation of the property in Morgan County.

Wagon Wheel Homes, LLC, owner Richard Migchelbrink is contesting the assessment of taxable value on a property at 21525 County Road R, where the four mobile homes are located but which he says are all unoccupied.

The property dispute was discussed Tuesday during a hearing with the Morgan County Board of Equalization, with voting membership including the Morgan County commissioners.

“Wagon Wheel Homes claims that four mobile homes are (tax) exempt because they belong to Sand Run Management and are not subject to property taxes, as they are inventory for resale from a dealer,” Morgan County Assessor Tim Amen said.

At issue is whether the property is a mobile home park, which Commissioner Mark Arndt has said he recalls was stipulated in a special use permit. He says operating as a dealership was not discussed upon granting of the special use.

Each of four mobile homes were assessed a value of $67,190 in May, and reduced to a value of $33,590 in June related to the inability to provide septic to the homes. Because they are sales inventory, Migchelbrink contends they should not be taxed.

The four homes are waiting to be sold or rented, Migchelbrink indicates.

“It is not odd to me to have a company bring in modulars until they are ready,” Commissioner Jon Becker said.

The units were in place Jan. 1, Amen said.

The property is zoned as agriculture with the special use for a mobile home park, Amen added. He additionally noted photos showing the mobile homes are 80% skirted, and showing utility installation.

“Why would a sales lot skirt them and place utilities,” Arndt said.

Migchelbrink has indicated utilities are not operational.

In notes shared with the Morgan County Board of Equalization, Amen indicated dealership information could not be found for the location. All units are skirted, wheels have been removed and the units blocked, tied down and stubbed for utility connections, his notes read. His documentation included photo evidence of those claims.

The hearing was continued to 9 a.m. Aug. 5, at which time further documentation from Migchelbrink could be considered to allow for a decision to be made by the Morgan County Board of Equalization.

“Provide us documentation of anything you feel makes your case,” Becker said.

The property owner may also be related to operation of Log Lane Mobile Park as Log Lane Mobile Park, LLC, on Larch Dr. in Log Lane and Davies Mobile Park as Davies Mobile Park, LLC, on E. Douglas Rd. in Fort Collins, a report from Amen reads. Those two properties are shown to be owned by Helen Migchelbrink.
